'It's Unconstitutional' - Court Says As It Lifts Proscription Of IPOB

IPOB members rally in Southeastern Nigeria

The Enugu State High Court has declared “illegal” the ban on the Indigenous People of Biafra, IPOB, saying the ban on the self-determination group's activities is unconstitutional.

Justice A. O. Onovo, who delivered the judgment on Thursday, October 26, 23, declared that the proscription of IPOB by the South-East Governors Forum led by former Governor David Umahi in 2017, was illegal and now null and void.

Mazi Nnamdi Kanu the IPOB leader through one of his lawyers, Bar. Aloy Ejimakor had asked the court to declare the ban on the self-determination group, including his arrest and detention, as unconstitutional and a violation of fundamental rights, noting that self-determination is not a crime and therefore cannot  be used as a basis for arresting, detaining and prosecuting him.

The High Court ruled in favor of Mazi Kanu and ordered the defendants to pay him N8 billion damages and make a public apology through newspaper publications.
